Depending on location, the right of way (ROW) could be 40' to 80' wide. That's what you need to be away from - railroad property. At Cajon summit, there are stones set along the ROW to indicate where railfans need to stay behind.

I guess the width of the RoW also depends on the railroad and location. Here in Jawjuh, in the towns a lot of buildings run right up the edge of the gravel, and in the countryside farmers fences do as well. The lines are not as well defined.

could it perhaps be the new government paradigm that seems to be encroaching it's way into our lives and states that we must be protected from our own recklessness ( stupidity )??

Unfortunately, there there seems to be a large population who have been born with little or no common sense. They take wedding/family portraits standing on railroad tracks.
When they ultimately get hit by a train, the lawyers line up to soak the railroads for millions in damages. In a perfect world, the tracks would be lined by 10ft fences on all sides, as the Union Pacific is doing (in many places) from Bloomington . IL to San Antonio, TX.
Just yesterday, a woman tried to beat a non-stop Metra train across the tracks. She lost. !**duh*!!

This is going to just going to sound plain mean, but if the truth hurts then it has more meaning.

I've always been a proponent of railroads enforcing their rights. You get hit while walking on the right way, get your leg chopped off while taking pretty little selfies, mangle the family car and decease your children while trying to beat the train - the railroad and it's hundred lawyers should send YOU, or your remaining family, a bill for whatever damages your stupidity causes. I figure that would include crossing signal equipment replacement, damage to track, ties, and ballast, repairs to rolling stock, physcological counseling for the crew, etc. It's a proven fact that folks won't respect railroad property even though it means their lives. Money is more important though and the possibility of being sued until they are living from a cardboard box down by the river is guaranteed to get their attention. The railroads already get villified everytime there is an accident anyway, so why not.
