Guess they couldn't get the Tri-Rail licensing. Good they're getting something out at least though for it.

Hopefully it will be paint-able without too much trouble and we will be able to do a re-paint.

I imagine they're using the same model for the bi-levels as the LA/SD Commuter, and from what I understand, they're not the easiest to repaint.

Why is it that those licenses aren't granted?

Does the railroad want more money than DTG is willing to pay?
Are the railroads concerned over their public image in the game?
Are they simply indifferent to a request from an UK company?

What actually is copyrighted/trademarked? The single colours, the colour combination, the actual paint scheme (pattern, swirls, line thinkness, and who knows what)? Besides the obvious logos and brand names?

Yeah, this looks pretty straight forward. Unlike the imitation Metrolink *!lol!* , which I'm still trying to figure out the maps of.

Its probably just my crappy Australian internet, But Is anybody else having an issue where none of the images in this thread are loading?

Not so fast!

For a little bit my images would not load for a couple of days and i live in the PNW.

No its not his internet at all.. I have viewed this thread on 4 different devices. My desktop, laptop, work desktop and ipad... and depending on my location - due to the images being directly hotlinked from facebook - they dont show up.
I can see them fine at home, but at work where FB is blocked, they dont appear.

I would guess it usually comes down to one of two issues....

1: They couldn't come to an acceptable financial agreement with DTG.

2: They don't want their public image potentially harmed by a sim where videos of staged crashes and derailments involving trains with their branding could be uploaded to the net. Especially if it's a staged re-enactment crash of a real life tragedy involving their commuter trains where passengers died. They are in the business of transporting people safely. They wouldn't want those videos creating a sense of fear and anxiety in current riders as well as scaring away potential new riders.

Different entities with different personnel running them. That means different points of view and opinions. Those that currently run Amtrak and Metro-North may not care about it like those running other commuter railroads.

It's like trademark defense. Some companies pursue to the ends of the earth trademark infringement cases, while others only go after the big fish....if even at all. Some are just happy with the free publicity. Railroads used to not charge for stuff branded with their logos and paint schemes. Now they do.

Harley-Davidson motorcycles is ultra-agressive in this field. I know, because I was once contracted out by them to microfilm their trademark court case files and the associated evidence for archival purposes. They didn't just go after big entities, they went after plenty of small fish too. Even small, local motorcycle clubs were sent cease and desist letters for handing out handmade photocopied rally fliers that had their HD logos somewhere on them. Even if they were kinda similar, but not a facsimile of their trademarked stuff.

I'm guessing the railroads don't care enough about the free user made locomotive texture skins enough to pursue action against them. Maybe it's because they aren't being charged for and/or because they are not being distributed from large entities like Steam. !*don-know!*
