If I sat the Board I’d ask KCVN to show me commitments from a minimum of 5 shippers. If they can do that then I’d tell UP.... “Sry. You’ve had the line sitting for 23 yrs and done nothing. 5 shippers for KCVN is better than no shippers from you.” A Railroad/rail line only has “value” if its being used. If UP isn’t going to use, then let someone else in there that will.

JMHO....

Of course, I also believe that those id10Ts in Washington need to reintroduce regulation of the trucking industry and throttle them back to 1950’s levels when they let the Teamsters and Organized Crime walk all over them.

But what do I know......

UP's said they've had potential buyers for the line every time someone has tried to buy the line but never discloses who.

Will UP actually sell the line or just keep hold of it as an asset ?? look at the moffat/glenwood springs sub more BNSF TO UP traffic , the craig branch will end following tennessee pass me thinks

The SurfBoard may do just that, left to its own devices. The question is whether all these outside spheres of influence have other things in mind. In the case of PanAm Southern (my favourite example) the Board was able to play it straight, much to the surprise of many of my colleagues. Admittedly,the statutory/regulatory point was different in that case, but the basic dynamic is the same.
